EVA Systems LLC ("EVA Systems," "we," "us," "our") is an Arizona limited liability company that develops and licenses artificial-intelligence software for the retail automotive industry. Our products include EVA CRM, a customer relationship management and communications platform used by automotive dealerships, and EVA Listing Agent, a vehicle-sourcing application.
This Privacy Policy explains how we handle information when you visit evasystems.ai, when you contact us, and when you use the EVA platform as an authorized user of a subscribing dealership.
This distinction matters, and it determines which parts of this policy apply to you.
As a controller. For information about our website visitors, prospective and current dealership clients, and the individual users we authorize on our platform, we decide how that information is used. Sections 3 through 9 describe that.
As a service provider. Our dealership clients use the EVA platform to manage their own customer records. We process that consumer information on behalf of and under the instructions of the dealership, which remains responsible for it. Section 10 describes that relationship. If you are a consumer who contacted a dealership, that dealership's own privacy policy governs your information, not this one.
Information you give us. Your name, business email address, mobile and business phone numbers, company name and role, and the contents of messages you send us.
Information about platform users. When a subscribing dealership authorizes an employee to use the EVA platform, we hold that person's name, work contact details, mobile number where provided, job role, assigned locations, permissions, and a record of their activity in the platform.
Information collected automatically. Device and browser type, IP address, pages viewed, referring pages, and similar analytics data collected through cookies and comparable technologies.
To provide, operate, secure, and improve the EVA platform; to create and administer user accounts and permissions; to send operational notifications about work in the platform (see Section 5); to respond to inquiries and provide support; to administer subscriptions and billing; to detect and prevent fraud, abuse, and security incidents; and to comply with our legal obligations.
EVA Systems sends text message notifications to authorized users of the EVA platform: employees of subscribing dealerships and EVA Systems personnel. These are operational messages about work assigned to you in the platform, items awaiting your response, escalations directed to you, and availability questions.
These are not marketing messages, and we do not send marketing text messages.
How you are enrolled. Your mobile number is entered into your platform user profile, either by your employer's administrator or by you. At the point of entry we display: "EVA will send you work notifications by text. Message frequency varies. Message and data rates may apply. Reply STOP to opt out, HELP for help."

How to opt out. Reply STOP to any message. You may also opt out by clearing the mobile number in your platform profile, or by contacting your administrator or rt@evasystems.ai. Opting out of text notifications does not affect notifications inside the EVA platform itself.

Your mobile information will not be sold or shared with third parties for promotional or marketing purposes.
We will not share your opt-in to an SMS campaign with any third party for purposes unrelated to providing you with the services of that campaign. We may share your Personal Data, including your SMS opt-in or consent status, with third parties that help us provide our messaging services, including but not limited to platform providers, phone companies, and other vendors who assist us in the delivery of text messages.
All of the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
We disclose information only as described here:
To service providers who perform functions on our behalf under contract: hosting and infrastructure, telecommunications and messaging carriers, analytics, payment processing, and support tooling. They may use the information only to perform services for us.
To your employer. If you use the EVA platform as an employee of a subscribing dealership, your employer administers your account and can see your activity within the platform.
For legal reasons: to comply with law, legal process, or a lawful governmental request; to enforce our agreements; or to protect the rights, safety, or property of EVA Systems, our clients, or others.
In a business transfer: in connection with a merger, acquisition, financing, or sale of assets, subject to this policy.
We do not sell personal information, and we do not share it for cross-context behavioral advertising. The mobile-information commitments in Section 5 apply without exception.
We use cookies and similar technologies to operate the website, remember preferences, and understand usage. Most browsers let you refuse or delete cookies; some site features may not function correctly if you do.
We retain information for as long as needed to provide the services, maintain business records, resolve disputes, and meet legal obligations, after which we delete or de-identify it. Platform data belonging to a dealership client is retained per that client's agreement with us.
We use administrative, technical, and physical safeguards designed to protect information, including access controls, permission scoping, encryption in transit, and audit logging. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
Consumer information that a dealership stores in the EVA platform, including its customers' contact details, inquiries, and communications, is controlled by that dealership. We process it only to provide the platform, under the dealership's instructions and our agreement with them.
Consent for any communication a dealership sends to its own customers is that dealership's responsibility, including obtaining and documenting it. If you are a consumer seeking access to, correction of, or deletion of your information, contact the dealership you did business with. We will support our client in responding.
Depending on where you live, you may have the right to request access to the personal information we hold about you, to correct it, to delete it, or to opt out of certain processing. Contact rt@evasystems.ai and we will respond as required by applicable law. We will not discriminate against you for exercising these rights.
The EVA platform is a business tool and is not directed to children. We do not knowingly collect personal information from anyone under 13.
We may update this Privacy Policy. When we do, we will revise the "Last updated" date above and, where the change is material, provide additional notice.
